Breaking: Delhi Court Discharges Umar Khalid and Khalid Saifi in a Delhi Riots case

Umar Khalid and Khalid Saifi were to continue to remain in judicial custody in the UAPA case alleging a larger conspiracy behind the riots.

New Delhi: Delhi Court discharges student activist Umar Khalid and UAH member Khalid Saifi in a Delhi Riots case (FIR 101/2020).

Both Khalid and Saifi are on bail in the FIR. However, they continue to remain in judicial custody in the UAPA case alleging a larger conspiracy behind the riots.

Umar Khalid and Khalid Saifi, both members of United against Hate organisation were protesting against the Citizenship Amendment protests in Delhi.

Umar, arrested by Delhi Police in September 2020, sought bail on grounds that he neither had any “criminal role” in the violence in the city’s north-east area nor any “conspiratorial connect” with any other accused in the case. Though Umar was not part of the mob, he and Khalid were accused of criminal conspiracy in the case.

Khalid had challenged the trial court order of March 24, 2020, denying him bail in the matter.

The bail plea was opposed by the Delhi Police.

Khalid, Sharjeel Imam, and many others have been booked under the anti-terror law Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code for allegedly being the “masterminds” of the February 2020 riots, which had left 53 people dead and over 700 injured.

The violence had erupted during the protests against CAA and NRC.

While granting bail to Umar Khalid in the FIR, the court had said that he cannot be permitted to remain behind bars on the basis of sketchy material against him. Noting that the investigation in the case was complete and chargesheet had also been filed, the court had observed that he “cannot be made to incarcerate in jail for infinity merely on account of the fact that other persons who were part of the riotous mob have to be identified and arrested in the matter.”
